The new Territory Plan, which commenced on March 31 2008, is available from the Legislation Register and is applicable for all new development applications and current policy matters.Draft variationsIn accordance with the Land (Planning and Environment) Act 1991, these draft variations have interim effect for the 'defined period'. 'Defined period' means the period commencing on the date that the draft Variation is notified in the government Gazette and terminating at the expiration of the day before:
The maximum 'defined period' for the interim effect is twelve months. This means that, during the defined period, the Territory, the Executive, a Minister or a Territory Authority shall not do any act, or approve of the doing of any act that would be inconsistent with the Territory Plan if it were varied in accordance with the draft Variation; or would be inconsistent with the Territory Plan. Section 11 of the Land
(Planning and Environment) Act 1991 (the Land Act)
also applies to any proposal concerning the Heritage
Places Register. Consequently, the provisions of a draft
Variation relating to the Heritage Places DO NOT
